Accommodation Terms & Conditions

 

The following Terms and Conditions apply to all bookings, we kindly ask that you take a moment to read them prior to completing your Accommodation Booking.

In these Terms and Conditions, the following definitions apply: “Company”, “our” or “we” means Ensarb Limited, Ensarb Estates, Pendrell Hall Estate, The Ashes Estate, The Mill Barns. “Booking” means the booking for accommodation, functions and/or any other services or items made with us. “Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking. “Property” or “estate” means the premises, buildings, grounds located at Pendrell Hall, The Ashes and The Mill Barns in its entirety. “Terms” means these terms and conditions.

Bookings

All Accommodation Bookings are subject to these Terms. At the time of booking we will take your credit/debit card details and you authorise the use of this card for any sums that become owing to us.

Payment & Charges
We do not accept cash payments. We accept most major credit & debit cards for your accommodation booking. As we are not a hotel, no items are chargeable to your room, payment for drinks at an event you are attending, need to be made on the night directly to the bar.

Terms
We require full pre-payment for the entire stay, prior to check-in and this is non-refundable.

Cancellation Policy and No Shows
Changes or Cancellation by the Company – In such circumstances you will be given a full refund but we shall have no further liability to you arising out of such cancellation.
Cancellation by the Guest – All bookings are NON-REFUNDABLE, we are able to transfer your booking to another wedding guest who has a valid promotion code from the wedding couple, subject to a reasonable administration fee.
Cancelled Wedding – We will FULLY REFUND your stay in the event the wedding you are due to attend is cancelled for whatever reason.

Liability
Guests’ liability for their account is not waived and guests agree to be held personally liable in the event that any indicated person, group, company or association fails to pay all or part of any charges incurred.

Deposits (where applicable)
In certain circumstances we accept a deposit against ‘The Ashes Country House’, ‘The Ashes Village Cottage’, ‘Pendrell Hall Lodge’ and ‘Pendrell Hall Cottage’. When these accommodation units are added to the ‘Wedding Couples’ ‘Wedding Account’, we ask for a deposit which is non-refundable and non-transferable (it is not possible to transfer the deposit to use against the wedding venue hire).

Price
The price of your Accommodation Booking is FIXED at the point you have PAID for that accommodation in FULL, if the accommodation has not been paid in full it is still subject to change. Our best prices are always displayed on our online booking form at the time of booking. Please note that New Year’s Eve stays are subject to a surcharge.

Occupancy

We try to be as flexible as possible but to meet fire & safety regulations we cannot allow guests to exceed the occupancy limit for the accommodation type booked. If occupancy levels are exceeded your booking will be terminated and you & other guests in that accommodation unit will be asked to leave for the safety of all other guests.
Child Policy for Occupancy Levels:
– All children over the age of 2 will be counted as adults when referring to occupancy levels.
– Babies and infants under the age of 2 will not be counted towards the occupancy limit, however we reserve the right to impose a reasonable limit to the number of children in this age group in any one room.
– All under 16s staying at our properties must be accompanied by an adult and must be supervised by an adult at all times.
Cots:
Due to the configuration or historic nature of our properties cots will not fit in all rooms, some rooms have full cots and we also have a limited number of ‘travel’ cots available at No Charge. Please note cot linen/bedding is not provided.
Extra ‘folding’ Beds:
Due to the design of the rooms it is not possible to add folding beds to any of the bedrooms except for The Lodge & The Cottage at Pendrell Hall. Where additional folding beds are available these are available at a cost of £25 but are only really suitable for children.
Our accommodation and associated areas are not suitable for parties and we respectfully request that any guests not staying overnight are not invited back to bedrooms or other overnight guest areas.

Pendrell Hall Estate - Orchard Stables 101-103, 105-210 & 212-220 Occupancy: 2

Due to the design of the rooms it is not possible to add an additional cots or folding beds to any of these rooms.

Pendrell Hall Estate - Orchard Stables 104 & 211 Occupancy: 3

Pendrell Hall Estate - The Lodge & Cottage Occupancy: 6+

Maximum Occupancy: 6+

6 adults/children plus extra child (under 16 on folding bed or cot for baby).

The Lodge & The Cottage both have the following available;

2x single child folding bed available subject to additional charge

2x cot’s available on request

Pendrell Hall Estate - The Hall Suites Occupancy: 2

The Hall Suites are not suitable for under 16s.

Drainage
Please note that Pendrell Hall has an old Victorian drainage system, it is VERY IMPORTANT that sanitary bins and nappy bins are used as even wet wipes WILL block the drains. Please ensure you pass this information onto the guests staying in the suites. Thank you.

Expectations of you (and your group)

You must not:

  • smoke anywhere inside any Ensarb Limited premises. This includes the smoking of e-cigarettes. Permitted smoking areas will be identified on site. Smoking inside our premises will result in a charge of £250 being applied to cover deep cleaning costs.
  • bring any pets onto Ensarb Limited premises, with the exception of assistance dogs;
  • bring any potentially dangerous or hazardous materials or equipment onto Ensarb Limited premises;
  • use any electrical appliances that may set off the fire alarm system, such as toasters, mini cookers or portable grills;
  • tamper with any fire alarms or emergency equipment. – TAMPERING WITH FIRE DETECTION SYSTEMS AND FIRE FIGHTING EQUIPMENT We reserve the right to take action against any guest found to have tampered / interfered with any fire detection equipment throughout the hotel, including detector heads in public areas and bedrooms, break glass points and fire extinguishers. Guests found to have tampered with any fire detection or fire fighting equipment will be charged with any costs incurred by Ensarb Estates due to their actions and additionally may be asked to leave the premises. Depending on the severity of the guest actions, the Police may become involved at our discretion. Should the fact that fire fighting or detection equipment had been tampered with come to light after the guest has departed, we reserve the right to make a charge to the guest’s credit / debit card, or send an invoice for the amount to the registered address.
  • remove, damage or destroy any Ensarb property. – REMOVAL OF HOTEL PROPERTY We reserve the right to charge guests the cost of replacing any items that are removed from the premises by them without consent. The charge will be the full replacement amount of the missing item, including any carriage charges. Should the fact that the item is missing come to light after the guest has departed, we reserve the right to make a charge to the guests credit / debit card, or send an invoice for the amount to the registered address. DAMAGE TO PROPERTY We reserve the right to charge guests the cost of rectifying damage, caused by the deliberate, negligent or reckless act of the guest to the property or structure. Should this damage come to light after the guest has departed, we reserve the right to make a charge to the guest’s credit / debit card, or send an invoice for the amount to the registered address. We will however make every effort to rectify any damage internally prior to contracting specialists to make the repairs and therefore will make every effort to keep any costs that the guest would incur to a minimum.
  • use any of the technology or WIFI provided by Ensarb Limited to download or access any unlawful or obscene material; or
  • cause unreasonable disturbance to our other guests, neighbours or any Ensarb Limited staff.
  • exceed occupancy levels
  • If you or your group cause damage or loss of any kind to the hotel, other guests or their property, you (as the person making the booking) will be responsible for that damage or loss and you shall be liable to pay to Ensarb Limited on demand, the amount required to make good or remedy such damage or loss.
  • INAPPROPRIATE BEHAVIOUR It is our policy that all our guests have the right to be treated with dignity and respect and as a responsible host we believe that we have a duty to our guests to protect them from inappropriate behaviour. Should any actions by a guest be deemed inappropriate by Ensarb Estates Staff, or if any inappropriate behaviour is brought to the attention of our staff, we reserve the right, after any allegations have been investigated, to take action against the guest. Depending on the severity of the guest actions, the Police may become involved at our discretion, or guests may be asked to leave. Guest Behaviour Guests are requested to conduct themselves appropriately at all times and to comply with Company procedures and/or requests with regard to conduct and respect for the property of the estate, its employees and guests and their health and safety. Guests are requested not to disrupt the comfort and enjoyment of other guests, the smooth running of the estate, or cause offence to other guests or our members of staff. We reserve the right to refuse accommodation or services or remove you and members of your party from the estate if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case we shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred.
  • invite non-resident guests back to your accommodation, our Guest Accommodation is not suitable for parties and we respectfully request that any guests not staying overnight, are not invited back to the overnight guest areas.

You and the members of your group must not resell or transfer your reservation (or any part of it) nor advertise, market or otherwise offer any Ensarb Limited accommodation for sale either on its own or as part of a combined offer. Ensarb Limited will not honour any bookings made in this way and does not accept any liability for doing so. If you or your group cause damage to the hotel, other guests or their property, or otherwise breach any of these terms and conditions, Ensarb Limited reserves the right to:

  • cancel your reservation with immediate effect and (if appropriate) eject you from Ensarb Limited premises;
  • retain all sums paid by you and/or charge you the full amount and/or
  • refuse future bookings from you and/or refuse you entry or accommodation at any of our properties.

Ensarb Limited will not be liable for any refund or compensation in such circumstances.

We reserve the right and you hereby authorise us to charge your credit or debit card for any damage incurred to your room or the estate during your stay by you or your party (including without limitation specialist cleaning) or for any items that are missing when you leave.

Guests Lost / Damaged Property

Should any guest lose any belongings during their stay or incur damage to the property, the Company’s total liability shall not exceed the value of the charges received by it under the Contract. If we find any lost property, we will make every reasonable effort to locate the owner and return it, but if we cannot locate the owner and an item is not reclaimed with 3 months of the guest’s departure it will be disposed of.

Parking

Our properties have free parking available. Cars and their contents are left at the owner’s / customer’s own risk. We do not accept responsibility for loss or damage (save as may not be excluded or restricted by applicable law).

Problems & Complaints

Every effort has been made to ensure that you have an enjoyable and memorable stay. If however, you have any problem or cause for complaint, it is essential that you contact us immediately so we can work to resolve it, failure to notify us during your stay does not allow us to rectify any issues.

Force Majeure

The Company accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.

Limitation of Liability

The Company will not be responsible for the loss or damage of any property left at the estate. The Company will not be liable for any indirect, consequential or pure economic loss or any loss of profit, goodwill or opportunity (whether caused by the negligence of the Company, its employees, contractors or otherwise). The Company’s total liability shall not exceed the value of the charges received by it under the Contract. Nothing contained in the Contract or in any other document referred to or incorporated in it shall be read or construed as excluding any liability for death or personal injury caused by the Company’s negligence or liability for fraud or fraudulent misrepresentation.

Check In / Out Times

Check in and Check out times are as stated on the room description. Late departure may result in a late check-out charge.

Accessibility & Mobility Impaired

We comply with the access requirements of local disability legislation, if you have special requirements please inform us at the time of booking. Accessible designed rooms are available at Pendrell Hall & The Mill Barns but due to the historic nature of The Ashes no accessible designed bedrooms are available at this time.

Your information We process information about you that you provide when making a booking in accordance with our privacy policy and cookie policy. By providing this information you consent (on your behalf and on behalf of each member of your group) to such processing and you warrant that all information provided by you is accurate. Telephone calls may be recorded from time to time to help us improve the service we offer you. All personal information stored and used by us is done so in accordance with our Privacy Policy.

Your rights You have certain rights under consumer protection legislation. Nothing in these terms or conditions shall limit or restrict the guests’ legal rights as a consumer. Advice concerning such rights may be obtained from a Citizens Advice Bureau.

Our liability We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents. We do not accept liability for failure to meet any of our obligations where such failure is due to events beyond our reasonable control. If we breach these terms and conditions for reasons within our control we shall only be liable for losses that are direct losses and a reasonably foreseeable consequence of such breach. We shall not be liable whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, for any indirect or consequential losses.

Where we are liable to you (save as prohibited by applicable law) our maximum liability to you whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the price of your reservation.

Our right to cancel / Your breach We may cancel your reservation at any time with immediate effect by giving you written notice (which includes email) if:

  • you do not pay us when you are required to do so; or
  • you break the contract between us in any other material way.

If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract.

Events outside our control We may also cancel your reservation if an event outside of our control (including industrial action, explosion, fire, flooding, and failure of power and/or water supplies or emergency evacuation) means that we are unable to make your room available to you. In this case we will contact you to let you know as soon as possible and:

  • if you have already paid for your room, we will refund your payment to you; or
  • if you have not yet paid for your room, you will not have to make any payment to us.

Save as set out above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control.This does not affect your statutory rights.

Severability If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies. All rights not expressly granted in these terms and conditions are reserved.

Governing Law and Jurisdiction The Contract and any non-contractual obligations arising in connection with it are governed by English law. The English courts have exclusive jurisdiction to determine any dispute arising in connection with the Contract, including disputes relating to any non-contractual obligations. Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the English courts (on the grounds that the English courts are not a convenient forum or otherwise).

The contract This contract formed when we confirm your reservation is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise
